ESTATE PLANNING

& PROBATE

A will is a legally enforceable expression of how and to whom a person wishes to distribute their property after death.  The law generally recognizes the right of a property owner to dispose of his property as they see fit, so long as the disposition is not illegal, and will attempt to enforce that right after person’s death by honoring his wishes.  The will is the instrument the law relies upon to learn exactly what those wishes are.

As with so many aspects of the law, however simple the law may appear, there are many traps for the unwary. Paul Fairfield is a will attorney who gets it right the first time.

Fairfield Law Firm prepares wills and other legal documents including, a Durable Power of Attorney, Medical Directive and Power of Attorney and HIPAA Authorization.

Paul Fairfield’s attention to detail ensures his client’s wishes are known, understood and honored. This is especially true in the context of wills, the history of which dates back centuries to a time when certain words and phrases, many of which are generally unused today or whose meanings have changed over time, had specific legal implications and effects.  In short, the law of wills has a long history and so does the language.

Paul Fairfield is conversant in the law and the language of wills and assists clients by helping them express their wishes in the appropriate terms and by anticipating and avoiding common impediments in the probate process that ensure final wishes are executed as intended.

Fairfield Law Firm will services include: Business continuation alternatives, Buy-sell agreements, Wills, Durable power of attorney, Medical power of attorney, Directive to physician, Testamentary children’s trust advice.
